Possibly still crestfallen over the Niners' NFC loss, 22-year-old rookie defensive end Aldon Smith was arrested on DUI charges Saturday morning in Miami. According to the Sacramento Bee, the wasted 49er was swerving in and out of lanes causing other drivers to brake to avoid hitting Smith's red Mercedez.

He spent over 3 hours in the clink. He was later released on $1,000 bond.

The 49ers released a statement saying: "We take these issues very seriously, but will reserve further comment at this time, as this is an ongoing legal matter. The 49ers will continue to gather the facts and monitor the developments closely."

On al lighter note, Smith was the league's defensive rookie of the month this past season, "and he is a candidate for defensive rookie of the year, an award that will be announced Saturday."
