As we mentioned yesterday, Cody Smith, the 15-year-old who lured at Richmond High School gang rape victim into a harrowing two-and-a-half-hour ordeal, will be set free today. Why? Well, according to ABC 7, "Prosecutors said he had lured the girl to the scene, but Judge Gregory Caskey said Smith's rights were violated by Richmond detectives during interrogations and that there was not enough evidence to send him to trial." During the 2009 homecoming dance rape, the victim was beaten, kicked, stripped, urinated on and raped - all with the apparent help of Smith, who failed to report the attack or help stop it.
Smith's father told KRON 4 Morning news that his son "should be compensated for the time he had been locked up for nothing."
Five of the six remaining suspects face life in prison.
