Migden was found at fault not only in rear-ending the other car, but also in hitting a guardrail earlier in the drive due to an unsafe turning move. Migden's cell phone use was found to have played at least a partial role in the situation. (Note here that Migden voted in favor of the hands-free cell phone requirement in cars.)

Migden, who says she doesn't remember a thing about this and says it might be from her leukemia medication, released a statement that "I am very sorry about the accident which I caused, I am not driving, I am in the process of undergoing a medical evaluation, and I will in no way shirk my responsibility for what happened," and refused further comment.
