<p>Last week was a whirlwind one for San Francisco Sheriff Ross Mirkarimi: on <a href="http://sfist.com/2015/08/10/mirkarimi_had_his_license_suspended.php">Monday he learned via reporter inquiry that his driver's license had been suspended</a>, on Tuesday we learned that <a href="http://sfist.com/2015/08/11/the_odd_story_broke_late.php">he's had a pretty rough driving record in the past year or so</a>, and by Wednesday <a href="http://sfist.com/2015/08/12/sheriff_ross_mirkarimis_suspended_d.php">his license was back in good standing again</a>. And now the embattled sheriff is saying that this is just another in a long list of ways Mayor Ed Lee is trying to get him down.</p>

<p>It's a story some disdained, like the San Francisco Examiner's Jonah Owen Lamb...</p>

<p>...though, to be fair, it's possible that my tongue-in-cheek use of "nightmare" might have been a bit too much for <a href="http://www.sfexaminer.com/author/j_lamb/">the excellent, hard-working Lamb</a>.</p>

<p>But others took the story quite seriously. (Look at the comments on any of <a href="http://sfist.com/tags/rossmirkarimi">SFist's posts on the issue</a> to see what I mean.) </p>

<p>From where Mirkarimi stands, however, this is all politics. While he doesn't appear to note <a href="http://sfist.com/2015/08/11/the_odd_story_broke_late.php">what I speculated on</a>, that the Chron was likely fed the initial suspended license story by anti-Mirk forces, he does have some choice words for Lee.</p>

<p>Mirkarimi's haters, <a href="http://www.sfchronicle.com/bayarea/article/S-F-Sheriff-Ross-Mirkarimi-says-Mayor-Ed-Lee-6445896.php?t=95285ef838baa6eec6&amp;cmpid=twitter-premium">he tells Matier and Ross</a>, "have capitalized on my mistakes and misfortunes. That’s fair game in politics. I can take that."</p>

<p>However, he still believes that the buzz around this latest issue to befall Mirkarimi “is about Mayor Ed Lee consolidating power” and turning SFPD (not the Sheriff's Department, which Mirkarimi oversees) 'into his Praetorian Guard.”</p>

<p>For those of you who fail to recall your history, <a href="https://en.wikipedia.org/wiki/Praetorian_Guard">the Praetorian Guard</a> were the elite but frequently corrupt private army used by Roman Emperors from 275 B.C. until their dissolution by Constantine I in 4 A.D. They're known for helping to assassinate Caligula, among other notable moments.</p>

<p>ANYWAY. Back to Mirkarimi. He says that “I know that without a contested mayor’s race, mine is going to be the top-of-the-ticket, pay-per-view event of the election" and argues that "the mayor ignores the mistakes of the SFPD or his own friends.”</p>

<p>“I’m already hearing about boasts of the mayor’s friends putting up $500,000 to beat me. They want their own police chief, their own fire chief, and now he wants one of his own as sheriff."</p>

<p>“This is a rough town...If my socks are mismatched, it gets reported negatively — but look at my overall record."</p>

<p>According to a statement from the San Francisco Sheriff's Department, the Ross-Mirkarimi's-suspended-driver's-license saga has ended, not with a bang but with a whimper (and a call to California's Department of Motor Vehicles). Still, some questions remain, and a lot of contradictions are emerging between when Mirkarimi is telling us and what the facts appear to be. If you haven't been following the case, <a href="http://sfist.com/2015/08/10/mirkarimi_had_his_license_suspended.php">catch up here</a> <a href="http://sfist.com/2015/08/11/the_odd_story_broke_late.php">then here</a>, and let's look at what's happening now.</p>

<p><strong>Another statement from Mirkarimi, in which he gives love to the DMV</strong><br>
On the heels of <a href="http://sfist.com/2015/08/11/the_odd_story_broke_late.php">Monday night's statement</a>, here's what Sheriff's Department spokesperson Kenya Briggs sent on Mirkarmi's behalf Tuesday at 4:55 p.m.:</p>

<blockquote>Sheriff Ross Mirkarimi today announced that the matter regarding his driver license has been resolved.</blockquote>
 
<blockquote>“I used the public phone numbers for the DMV and traversed their process. I found them to be efficient and helpful, and after explaining the matter and filing the proper paperwork the matter has been resolved.”</blockquote>
 
<blockquote>Sheriff Mirkarimi was informed for the first time on Monday that the DMV had suspended his driver license, except for his ability to drive for his employment duties, for a failure to file an accident report. In fact, the Sheriff immediately reported the accident to his insurance company as well as to SFSD personnel. He was informed by his insurance company that the matter would be processed. The Sheriff learned only yesterday that his insurance provider did not file a report with the DMV as he believed. That report has now been filed.</blockquote>
 
<blockquote>Neither the Sheriff nor his insurance company had been notified by the DMV or any other entity regarding a license suspension or restriction. The Sheriff’s insurance coverage has remained uninterrupted.</blockquote>
 
<blockquote>Sheriff Mirkarimi was involved in a non-injury accident on 10/2/14. There was no damage to the City car that the Sheriff was driving but there was claimed damage to the other car. He provided his personal insurance information to the other driver as there was no City insurance information accessible in the City car.</blockquote>
 
<blockquote>Sheriff Mirkarimi will work with City administration on completing any remaining requirements.</blockquote>

<p>I will admit to an eye roll at "traversed their process" but sounds pretty simple, right? Well, hang on.</p>

<p><strong>Did the cop who pulled Mirkarimi over in June mention the Sheriff's suspended license?</strong><br>
Typically, when an SFPD officer pulls you over and writes you a ticket, they "run" your license — that is, they look to see if you have any outstanding warrants and make sure your license is in good standing. As <a href="http://sfist.com/2015/08/11/the_odd_story_broke_late.php">we noted yesterday</a>, SFPD pulled Mirkarimi over and ticketed him for an alleged turn violation, which <a href="http://www.sfgate.com/bayarea/article/Mirkarimi-didn-t-tell-police-about-crash-in-6438830.php">we now know</a> went down at Second and Folsom on June 9. </p>

<p><a href="http://sanfrancisco.cbslocal.com/2015/08/11/sf-sheriff-mirkarimi-suspended-driver-license-issue-resolved/">Bay City News reports</a> that that ticket has "been resolved, but the sheriff was not advised of any problems with his driver’s license during that process, sheriff’s department officials said." So what happened there? Did the cop fail to run the license, was the suspension not in the system, did the cop decide not to tell Mirkarimi about the suspension (for whatever reason?) or was Mirkarimi informed and he, like, forgot or something? </p>

<p><strong>Mirkarimi didn't properly report the October 2 collision</strong><br>
"<a href="http://www.sfgate.com/bayarea/article/Mirkarimi-didn-t-tell-police-about-crash-in-6438830.php">The Chronicle has learned</a>" (most likely, after a Mirkarimi opponent tipped them off) that Mirkarimi "failed to alert police" about the collision that started the license suspension ball rolling, a failure that's a clear violation of Sheriff's Department policy.</p>

<p>"Under a long-standing policy last revised in May 2013 and signed by Mirkarimi, all crashes involving Sheriff’s Department vehicles have to be reported to police for investigation," the Chron says, "However, there is no evidence Mirkarimi told police about the October accident. The Police Department has no accident report on the incident, officials with knowledge of the matter said, and DMV records do not show a police report number."</p>

<p>“I made a verbal report, and I will rectify it if there’s not a hard copy — I will make sure there’s a hard copy to reflect it,” Mirkarimi says.</p>

<p>“I just simply did not because I thought my personal insurance was taking care of it. If that was a lapse, I will make sure it is rectified.”</p>

<p><strong>About that personal insurance thing...</strong><br>
Mirkarimi's statement Monday said that "Sheriff Mirkarimi was informed by his insurance company that they would take care of the matter, and you can scroll up to see that Tuesday's read "He was informed by his insurance company that the matter would be processed."  However, the Chron spoke to Mirkarimi’s insurance company, CSAA Insurance Group, which says "NOPE!"</p>

<blockquote>Mirkarimi’s insurance company, CSAA Insurance Group, said Tuesday that it had rejected the sheriff’s claim in December because he hadn’t been driving his private car.

<p>“We reviewed it and determined at that time that, because he was driving a city vehicle, the city would provide coverage because the city is self-insured,” said company spokesman Jason Willett.</p>

<p>“<strong>The customer was notified several times that we wouldn’t be processing the claim</strong>,” he added.</p>
</blockquote>

<p><strong>Mirkarimi appears to have violated the DMVs change of address regulations</strong><br>
According to the Chron, the DMV sent Mirkarimi three letters informing him that his license was in peril. "The third letter came back in February as 'undeliverable,' apparently because Mirkarimi had moved without alerting the DMV, said agency spokesman Artemio Armenta. The agency then suspended Mirkarimi’s license."</p>

<p>In fact, it wasn't until Mirkarimi was pulled over in June that Mirkarimi contacted the DMV to update his address, the Chron reports.</p>

<p><a href="https://www.dmv.ca.gov/portal/dmv/detail/forms/dmv/dmv14">A quick look at the DMV's site</a> reveals that drivers registered in California "must report a change of address to DMV within 10 days of the change." So, whoops?</p>

<p>OK, though, let's be realistic, here: how many of us actually follow that rule? Not all of us, right? So the question here, I guess, is if we hold San Francisco's sheriff to a higher law-abiding standard?</p>

<p><strong>Mirkarimi's multiple explanations on why he didn't offer up city insurance</strong><br>
Pretty much everyone knows that <a href="https://www.esurance.com/info/car/myth-car-insurance-follows-the-driver">car insurance applies to the car, not the driver</a>. I have insurance for my Smart car in my name, but if I wreck your Corvette, my Smart car's insurance company is going to tell me to fuck off (as Mirkarimi's says they did). It's weird that Mirkarimi wasn't aware of this fairly commonly-known fact, a piece of ignorance he repeated in both Monday's statement and Tuesday's.</p>

<p>But even weirder than that is how Mirkarimi said in both statements that "He provided his personal insurance information to the other driver as there was no City insurance information accessible in the City car," then told the Chron something very different.</p>

<p>Instead, "Mirkarimi said he gave the other motorist his personal private insurance because the other motorist didn’t trust the city insurance and registration, which says the cars are renewed and registered until 2099."</p>

<p>“'When a civilian looks at that, they say, ‘Oh my God, this doesn’t look real,’'” Mirkarimi told the paper. </p>

<p>Wait, what? Where did <em>this</em> come from? If we have two statements from Mirkarimi saying there wasn't accessible insurance information, what's this whole <em>no, actually the other driver wouldn't take it</em> thing about? In his defense, Ross explained that he was "breaking the ice of a very stressful situation" regarding the media. <p><strong>Joanna Rees</strong> continues her tour of San Francisco neighborhoods with two very different stops this week. This evening, the milky-white ladycandidate will stop by The Creamery at 4th &amp; Townsend around 6:30 p.m. for <a href="http://www.joinjoanna.com/talk_of_the_neighborhood_mission_bay">Talk of the Neighborhood Mission Bay</a>. Then, on Saturday, she'll be down in <a href="http://www.joinjoanna.com/talk_of_the_neighborhood_bayview">the Bayview at Frisco Fried</a> at 11 a.m. for another conversation about San Francisco's future. <p><strong>Bevan Dufty and David Chiu</strong>: the former supe and the current supe will be getting down at Rasselas Jazz Club on Fillmore this Thursday evening along with District Attorney candidate David Onek. The event is hosted by the African American Democratic Club and if you're not already sweet on Dufty or Chiu's charming personalities, you could always down a couple glasses of the bar's honey wine. <a href="http://aadcsf.com/index.html">Details</a>.</p>

<p><strong>John Avalos and Phil Ting</strong> The SF Women's Political Committee event we <a href="http://sfist.com/2011/07/19/this_weeks_mayoral_candidate_cameos.php">mentioned last week</a> was listed with the wrong date on the group's facebook page. If you're a woman, or at least someone who supports women (that should be all of you), you can still make it to this Thursday's event featuring Phil Ting and John Avalos. It is unfortunately still happening at Nobel Bar on Polk Street, but they've created a signature cocktail just for the event. It's called a Mayoral Mixer, which we assume is made with one part political experience and two parts cash, strained over an icy voter population and garnished with a big fat ego. <a href="http://www.facebook.com/event.php?eid=245664428778885">Details</a>.</p>

<p><strong>Ross Mirkarimi</strong>: Sure, the D5 supe is running for Sheriff, not Mayor, but his fundraising event a "Comedy Variety Show" seems worthy of a mention. It happens this Friday at Carnelian by the Bay (behind the Ferry Building) from 6 - 9 p.m. and features several local comedians who we have never heard of, but we're sure are all very hilarious. <p>In Pac Heights, the problem is <a href="http://sfist.com/2011/02/07/city_might_ease_up_on_new_restauran.php">too much empty retail and not enough restaurants</a>, but down in the [ahem] Lower Fillmore area District 5 Supervisor and <a href="http://sfist.com/2011/02/22/ross_mirkarimi_announces_run_for_sh.php">potential sheriff</a> Ross Mirkarimi sees a different factor holding back revitalization of the district: <strong>Businesses using ground-floor storefronts as offices</strong>. Don't these businesses know that's where the boutiques are supposed to go?</p>

<p><a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/03/03/BAH91I2G42.DTL">According to the Chronicle</a>, Mirkarimi has a proposal in front of the planning commission today that would require ground-floor businesses be "active use". While updates from the planning commission weren't immediately available this afternoon, if Ross got his way, the current street-level offices will have to go elsewhere (upstairs perhaps) and open the storefronts to businesses that will attract pedestrians (who we know love to spend money) and won't close up right at 5 p.m.</p>

<p>We tried to remember the shops we passed on our last stroll along Fillmore from McAllister to Bush Streets (The blocks Mirkarimi's proposed ordinance would affect) and it seemed pretty lively to us. There's a <a href="http://www.jubili.com/">fro-yo place</a> and a Sunday Farmer's on those blocks, after all, but as Gabriel Metcalf of SPUR told the Chronicle, "It is not so much a problem of vacancies as it is closed blinds."</p>

Sheriff Michael Hennessey, whose eighth term expires next January, <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2011/02/18/BAQI1HQC9R.DTL&amp;feed=rss.news">announced Friday</a> that he won't seek re-election. Mirkarimi had previously mentioned he was considering <a href="http://sfist.com/2011/02/01/so_which_mayoral_candidates_already.php">running for mayor</a>, but the move for sheriff isn't as surprising as it might sound.</p>

<p>Mirkarimi graduated from the San Francisco Police Academy in 1996, has his Peace Officer Standards and Training certification from the state, and he worked for nearly a decade in the district attorney's office investigating white-collar crimes before his stint as supervisor.</p>

<p>We also can't forget Mirkarimi has already built quite a reputation as a crime-fighting neighborhood hero. <strong><a href="http://sfist.com/2007/08/31/a_hero_aint_not.php">As SFist reported back in 2007</a>, the beloved sup <a href="http://www.sfist.com/2005/07/01/sfist_blotter.php">stopped a burglary</a> several years back, <a href="http://sfgate.com/cgi-bin/article.cgi?f=/c/a/2007/08/31/BA4NRTFJP.DTL&amp;tsp=1">saved someone's life</a> in Buena Vista Park, and <a href="http://sfist.com/2007/08/31/a_hero_aint_not.php">caught two people</a> involved in a drive-by shooting.</strong> Pretty great track record so far.</p>

<p>You know that not-so crazy plastic bag ban <a href="http://bit.ly/fFJa0y">spearheaded by San Francisco Supervisor Ross Mirkarimi</a>? Well, openly Republican (heh) Governor <a href="http://www.calitics.com/diary/12890/arnold-wants-plastic-bag-ban-to-move">Arnold Schwarzenegger now also supports the eco-intelligent ban</a>. So, you know, kudos to you, Mirkarimi.</p>

<p>The bill, which collapsed in the Senate this year, faces strong opposition from special interest groups like the Virginia-based <a href="http://www.americanchemistry.com/s_acc/index.asp">American Chemistry Council</a>. And, with an antiseptic name like that, you can be sure that they don't necessarily have the public's best interest at heart.</p>

<p>The <a href="http://web.mac.com/sfskateclub/iWeb/Site/home.html">S.F. Skate Club</a>, a youth skateboarding program dedicated to providing children with skateboarding lessons and mentoring, hosted an art show last Friday in Supervisor Ross Mirkarimi’s office at City Hall.  The show featured a series of hand-painted skateboard decks by local youth skateboarders, ages 8 to 13.  Although none of the artwork was for sale, the club was hoping the show would help raise awareness about the need for a skateboard park in Golden Gate Park, near Stanyan and Waller streets.   </p>

<p>Supervisor Mirkarimi originally drafted the legislation for a new skateboarding facility in Golden Gate Park; due to concerns from surrounding businesses and neighbors about the kind of crowd the park might attract, however, planning has since been put on hold.  Skate park supporters feel the concerns are ironic, because the proposed Upper Haight location is a neighborhood that prides itself on diversity.   </p>

<p>San Francisco currently has one skate park, which is basically an empty swimming pool in a remote corner of Crocker-Amazon Park. Built in 2001; the park is rarely ever skated because of its old-fashioned design and out-of-the-way location.  A second park is scheduled to open this Saturday, June 28 in Potrero Del Sol at 25th and Utah streets.  (Continued after the jump.)</p>]]></content:encoded></item></channel></rss>
