Brian Devine at Calitics notes: "[T]he panel that issued this Order (the motions panel) is not the same panel that will hear that case on the merits.  The merits panel will be selected shortly before December 6th and we don't know the three judges who will be on the merits panel.  <strong>But this is a very good sign that the appeal could be dismissed on the ground of standing alone.</strong>" For now, this means no same sex weddings anytime soon -- until <s>December</s>God knows when. <p>Judge Vaughn Walker, the federal judge who last week <a href="http://sfist.com/2010/08/04/federal_court_against_prop_8.php">overturned</a> Proposition 8, California's same sex marriage ban, <strong>issued a ruling to lift the stay on same sex marriage in California</strong>. The majority of the crowd gathered at City Hall, as expected, is elated. </p>

<p><s>So, you <a href="http://sfist.com/2010/08/11/gay_activist_befriends_mormon_missi.php">matrimonial types</a> might want to head down to San Francisco City Hall as soon as possible to get married. (You know, if marriage is your kind of thing.) Marriage for all couples is now taking place, but not for long.</s> Judge Walker's decision to overturn Prop 8, <a href="http://sfist.com/2010/08/04/federal_court_against_prop_8.php">as we previously reported</a>, under <a href="http://sfist.com/2010/08/05/prop_8_backers_appeal_court_ruling.php">appeal</a> in the 9th Circuit.</p>

<p><strong>Update:</strong> Judge Walker's ruling will keep gay marriages <a href="http://cbs5.com/local/same.sex.marriage.2.1857137.html">on hold until at least Aug. 18</a>. At that time, Proposition 8 will no longer be enforced; that is, unless the 9th Circuit Court decides to uphold it. <p>After California's gay marriage ban was overturned last week, U.S. District Judge Vaughn Walker said he would <a href="http://cbs5.com/politics/same.sex.marriage.2.1855771.html">make a decision today</a> whether or not marriages could resume. If Walker chooses to lift the stay, that  means marriage could start as soon as noon. </p>

<p>As <a href="http://sfappeal.com/news/2010/08/decision-on-if-same-sex-marriage-can-resume-expected-thursday.php">SF Appeal</a> reports, SF City Hall is ready to start marrying couples, "and SF's Assessor-Recorder Phil Ting has said 'We're absolutely ready. We can't wait for Judge Walker to lift his stay. We're working with the County Clerk's office. <strong>If they stay is lifted we are prepared to stay open until 8 tonight and stay open Saturday and Sunday from 9-to-5.</strong>'"</p>

<p>Now, if the stay is lifted and marriages can resume, it will be a short period before, presumably, it's closed again by the 9th Circuit. Walker's decision is expected by noon.</p>

<p>In related news, even <a href="http://www.huffingtonpost.com/2010/08/12/glenn-beck-gay-marriage-n_n_679691.html">Glen Beck doesn't think gay marriage is a threat</a> to the fiber of America. And, dear God, we have to agree with him.</p>

<p><strong>Update 10:04:</strong> Gavin Newsom has appeared outside City Hall. Also al ine has already formed inside City Hall, waiting for the permits. CBS 5 <a href="http://cbs5.com/">announces</a> that "the California Supreme Court has denied a request to stay its decision legalizing gay marriage."</p>

<p>It was shot down <a href="http://laist.com/2008/06/04/justices_deny_s.php">in a 4-3 vote</a>. Now, couples of the same sex can get married n June 17, after the order becomes finalized on June 16 at 5 p.m.</p>
