There's big legal news concerning the Barry, none of which involves Curt Schilling or Grand Juries. Oh no. Barry has just been slapped with a lawsuit by an inmate in a South Carolina prison, Jonathan Lee Riches (aka "the White Suge Knight), for fraud. No, not for breaking the record while on the juice, but for perpetuating a "Fraud Against Mankind," which Lee Riches calls "Batman and Identity Robbin." The Smoking Gun has the details, but from a quick perusal here are some of the claims made:

A Federal Appeals Court today ruled that Josh Wolf had to turn over what is quickly becoming the hottest video since the Paris Hilton sex-tape or else go back to prison. The three-person court ruled unanimously that Wolf had to turn over the tape because there were no grounds for resisting the subpoena. The reason? "He simply videotaped what people did in a public place," the judges wrote. .

The 'Gate is reporting that Josh has been granted bail by the 9th Circuit Court of Appeals, to wit:

In a brief order, two judges of the Ninth U.S. Circuit Court of Appeals said Wolf was entitled to bail because the government had not shown his appeal of a judge's contempt-of-court ruling was frivolous or intended solely to delay the proceedings...The court said another panel would rule on Wolf's appeal of the contempt order while he is free on bail. If he loses the appeal, he could be sent back to federal prison until the grand jury's term expires next July.
Josh could be free on bail as early as this afternoon. Of course, being in jail hasn't stopped him from posting to his blog via the postal system. While there, he also spoke to everyone from the Bay Guardian to Judith Miller. Videobloggers on the right have chimed in to support the Justice Department's case against Josh, but he can count for his support local well-wishers at numerous benefits, a public statement from Reporters without Borders and a $30,000 grant to defray legal costs from the Society of Professional Journalists. Looks like the Google guys can dish out the privacy-invasion but can't take it -- they've sued the guy who was designing their super-secret Boeing 767 for violating a confidentiality agreement. After the designer was fired, he went to the press and revealed, among other things, that the Google founders wanted to install hammocks and a California king-sized bed in the plane, and that the project had been described as "a party plane."

We were shanghaiied in the best possible way yesterday, getting into our friend's car after lunch at the Slow Club. A spontaneous decision was made to go south, and we had a mini-vacation of one drink at the Moss Beach Distillery in Pacifica. By the end of the night we were hanging out at a Korean hostess bar in the Richmond, smoking cigarettes and listening to Aretha Franklin. Needless to say, this post is a day late and more than a few dollars short...

We're currently waiting for our gut instinct -- that Yahoo has, in fact, purchased Flickr -- to be proven right on Tuesday. And by "gut instinct," we mean we shook the old Magic 8-Ball and got "All signs point to yes."
