ABC 15 Arizona reported on the incident, sharing an account of what happened as described in court documents. The Scottsdale PD said that Maxwell answered his door with a silver handgun in his hand when the delivery driver arrived. He allegedly pointed the gun at her head, then "reportedly lowered the gun but kept it up against the wall near the door as the driver handed over the food at the doorstep." The driver then called the police, and after they arrived, they say that Maxwell had "strong odor of intoxicating liquor" on his breath, and that he seemed to be intoxicated. On top of that, Maxwell was also allegedly verbally aggressive, reportedly yelling anti-police statements while he was being booked. The news channel also shared a security video of Maxwell being arrested.

Previously, Maxwell was in the news after a Trump-supporting waiter allegedly refused to serve him at a restaurant in Alabama, supposedly citing his protest as the reason for the refusal. But later reports say that the restaurant denied this was the reason, and that it was actually Maxwell's friend who was refused a beer because he had an expired ID. Regardless, Maxwell said he stands by his account of the incident.

KRON 4 says that Maxwell was projected to be the A's starting catcher for the upcoming MLB season.

A bartender an an upscale Oakland restaurant is behind bars today, after witnesses say they watched him beat a homeless man to death outside his place of business.

The alleged homicide happened outside Flora, which describes itself as "an Art Deco restaurant and bar in downtown Oakland" on its website, at around 4:15 p.m. Sunday.

The East Bay Times reports that 42-year-old Cooky York was "panhandling aggressively" outside Flora when he "got into an altercation with a relative" of 29-year-old Oakland resident Juan Espino, a bartender at the restaurant.

When told about the incident, Espino walked out of the restaurant and confronted York, the EBT reports.

Following the verbal confrontation, police told KTVU that Espino "went to an upstairs office and got a baseball bat."

Subsequent surveillance video shows Espino running toward the victim, who is walking away from him, KTVU reports.

According to the Chron, "A witness said he saw the killer run out a nearby bar and club the victim in the head from behind with a baseball bat." According to KTVU, he "came up to the victim from behind and, with two hands, swung the bat, hitting the victim."

Witnesses say Espino then ran back up the street, tossing the bat down an alley adjacent to the bar, the Chron reports. Investigators say that the two men did not know one another prior to the attack.

Witnesses to the attack flagged down a passing patrol car at 4:18, and emergency responders transported York to a hospital, where he later died.

According to the EBT, Espino fled the scene and was later arrested at his Oakland residence "after police identified him through witnesses and physical evidence." He was booked into Santa Rita Jail on suspicion of first-degree murder early Monday.

On Wednesday, Espino made his first appearance in court, where he Alameda County prosecutors charged him with murder as well as an enhancement and an enhancement for allegedly using the bat as a deadly weapon, KTVU reports.

Espino's family and friends packedthe courtroom "to support him," the EBT reports. According to KTVU, "One man in the audience raised his arm in the air, but Espino did not appear to respond."

In a written statement, Flora Restaurant says that "Sunday's events are tragic and heartbreaking and will have a lasting effect on much of our staff and community. We send our deepest condolences to the victim's family, and to anyone else who was affected by this horrific tragedy. The world has far too much violence in it."

He is no longer employed by Flora, KTVU reports, and "was not on the clock at the time of the killing."

Espino, who did not enter a plea in Thursday's hearing, is expected to do so during his next court appearance, on November 30. Until then, he remains in custody without bail.

Two Arrested After Brawl At Ocean Beach Safeway

An allegedly violent shoplifting team was taken into custody Sunday, after a showdown at one of San Francisco's most troubled Safeway grocery stores.

SF News

arrest

crime

ocean beach safeway

Safeway

sfpd

shoplifting

Eve Batey

An allegedly violent shoplifting team was taken into custody Sunday, after a showdown at one of San Francisco's most troubled Safeway grocery stores.

According to the San Francisco Police Department, officers were called to a business on the 800 block of La Playa Street at 3:15 p.m. Sunday on reports of a disturbance.

There's only one business on that block — the Safeway grocery store, located at 850 La Playa Street, also known as one of the city's "Sketchiest Safeways," and adjacent to a violent mugging this past August.

This time, the issue was inside the establishment, police say, as two 32-year-old men "stole merchandise from store." When the suspects were confronted by a 24-year-old male store security guard, they hit him with a chain, leaving him injured.

Officers with the SFPD were already on the way, however, and arrested the crime team on the spot. The guard was determined to have suffered injuries that are not considered life-threatening, and is expected to recover.

It's been nearly two years since a San Francisco debutante allegedly mowed down two kids in a Marina crosswalk as she drove her SUV while allegedly under the influence. But other than a brief booking the day of the crash, the suspect hasn't spent a day in jail, continuing to plead not guilty as the case makes its slow way to trial.

A refresher, for those of you who'd forgotten the case: It was 8:30 a.m. on November 4 of 2015 when witnesses say that then-30-year-old Sea Cliff resident Kirsten Andereck struck two Marina Middle School 7th graders who were walking in the crosswalk at Bay and Buchanan Streets.

According to police reports that the time, an ice cream delivery truck had stopped in the westbound lane of Bay Street to allow 12-year-olds Peter Nguyen and Julian Melendez to cross. Witnesses say that Kirsten Andereck instead passed the truck on the left and struck the kids with her white Volkswagen Tiguan SUV.

The collision was hard enough, ABC 7 reported at the time, that "the boys were launched into the air by the impact, thrown across the intersection. Their backpack, clothes, and shoes left scattered in the street."

Andereck, who'd graduated from St. Ignatius College Preparatory in 2001, was a debutante at a Cotillion event hosted by the Cotillion Club of San Francisco in 2004. She was most recently employed as a teacher at several kindergarten and elementary schools in the city, and has a master’s degree in bilingual education from the University of San Francisco.

Her parents are Helga Andereck and Dr. William Andereck, who at the time of his daughter's arrest was an internist and the medical director of California Pacific Medical Center’s Program in Medicine and Human Values.

She was arrested at the scene on suspicion of driving under the influence of alcohol or drugs, police said at the time.

The next day, Andereck was released on $230,000 bail, after being charged with two felony drunk-driving counts, with one of those regarding the causation of great bodily injury, as well as two counts of child endangerment with enhancements of allegations of great bodily injury. She pled "not guilty" on November 10, represented at the time by two private defense attorneys: V. Roy Lefcourt (a defense attorney featured in this 1998 SF Weekly cover story on gang homicides) and Betsy Wolkin (perhaps best known as Ross Mirkarimi's defense lawyer during his domestic violence case).

“This has been an exceptionally emotional” time for Andereck, Lefcourt said following her appearance in court to enter her not guilty plea. According to media reports at the time, Andereck was in fact so distraught by the case that she's "had to be hospitalized the last few days," Lefcourt said.

Meanwhile, the kids were also being hospitalized, in their cases for broken bones and "traumatic injuries," an attorney for their family said. They had both returned to school by August of 2016, when their families announced a civil lawsuit against both Andereck and the city of San Francisco, as they say safety improvements to the intersection might have prevented the collision.

And that brings us to today, where the wheels of justice continue to turn. A look at court records shows that the civil suit brought by the victims against Andereck and SF continues, the most recent filings made on October 12 of this year.

But what of the criminal case, tweeted so openly by the District Attorney's office when charges were filed? That, too, winds on, as DA's spokesperson Max Szabo tells SFist that Andereck's next appearance in court is November 16 (it's case number 15024617, to be called at 9 a.m. in Department 23 at the 850 Bryant courthouse, the court website says).

But that appearance is just a hearing, Szabo says. He confirms that Andereck "hasn’t changed her plea" to any of the charges, which means that unless a plea deal is reached, a trial is inevitable. When asked about a possible trial date, however, Szabo said regretfully that he had no details on timing of a "final outcome," meaning that we might expect this case to drag on for some time to come.

Faithful newshounds might recall last month's tale of a seemingly troubled woman who repeatedly used BART's trains as restrooms. We now have an update, it seems, as BART has announced they've nabbed the alleged culprit.

Back in September commuter Allen Nunley went to BART with video he captured of the woman copping a squat as she rode the train, but after no response from the transit agency he took his video to the media, saying “As BART riders, we pay a lot of money to ride BART, and it’s just really ridiculous that BART staff cannot do anything about that."

"Everyone on the train is just covering their mouths and everything. They just can’t deal with it either. This particular time I just had enough.”

Nunley is likely pleased, then, to hear that BART staff has done something: According to KRON 4, the woman was arrested by BART police Friday, after yet another rider posted photos of the suspect as she went about her business.

This time, it was BART rider Susan Greenlee Edwards who caught the suspect on camera "after watching her urinate at around 5:53 a.m. on the Pittsburg-Bay line heading into San Francisco." She sent the photos to KRON 4's Stanley Roberts, who posted them to Facebook and Twitter.

It was shortly after that that BART says they arrested the woman, taking her "into custody for a no-bail warrant."

But while BART tweeted happily regarding the catch...

...it turns out the arrest us un-pee-related. Instead, Roberts reports, she was arrested by BART police for "active warrants" including the no-bail one, which was for "fire related crimes."

She also had "methamphetamine products" on her person, BART spokesperson Alicia Trott (who, interestingly, says the situation only came to BART's attention "about a week ago" despite a September report on the woman's alleged behavior) says.

But since the suspect wasn't ticketed for her alleged bathroom behavior — according to Roberts, despite the ample photographic evidence BART cops won't ticket her unless they see her dropping a load in person or riders make a "citizen's arrest" — she won't be banned from the system. That means that when she's released from jail, there's nothing stopping preventing her future pit stops on one of the transit agency's trains.

Zain Jaffer, now-former CEO of Vungle, a San Francisco-based video ad platform, was arrested late last week, as prosecutors charged him with sexually abusing and assaulting his 3-year-old-son, writes the Chron. Jaffer was removed from his position as CEO of Vungle last week as well, shortly following news of his arrest.

According to San Mateo County's inmate lookup system, Jaffer is specifically being charged with the following: assault with a deadly weapon, child abuse, battery upon an officer and emergency personnel, lewd act upon a child, and oral copulation of a person under 14. The Chron also says that Jaffer was also initially charged with attempted murder, but prosecutors dropped that charge as they believe there isn't sufficient evidence to prove his intent to kill, according to San Mateo County District Attorney Stephen Wagstaffe. Per VentureBeat, Wagstaffe also said that the battery charge stems from Jaffer resisting arrest.

A spokesperson from Vungle spoke with VentureBeat, emphasizing that the company has already dismissed Jaffer. They said, "While we do not have any information that is not in the public record at this point, these are extremely serious allegations, and we are shocked beyond words. While these are only preliminary charges, they are obviously so serious that it led to the immediate removal of Mr. Jaffer from any operational responsibility at the company. The company stressed that this matter has nothing to do with Mr. Jaffer’s former role at the company." Additionally, Jaffer's attorney, David Olmos, said that his client will be pleading not guilty, and that he has no public statement to issue at this time.

Forbes' report on the arrest says that it was allegedly Jaffer's father who called the police to his home in Hillsborough. Wagstaffe tells them that when the officers arrived, they allegedly found Jaffer "engaged in the illegal contact with the minors."

You can read Vungle's full statement below, which they shared in a tweet.

As San Francisco Police Department Officer Elia Lewin-Tankel continues to fight for his life, the driver who allegedly struck him then fled has pled not guilty to the crime.

As previously reported, Lewin-Tankel was struck by the driver of an SUV while on bike patrol on Turk Street between Franklin Street and Van Ness Avenue last Wednesday.

The collision was witnessed by multiple police officers who were at the scene investigating a firearms case, and a subsequent investigation revealed that the suspect vehicle — a Lexus SUV subsequently found abandoned near Buena Vista Park — bore a stolen license plate.

Police linked a man they identified as "50-year-old Maurice A. Johnson" to the crime, booking him into San Francisco County Jail on charges of "use of a deadly weapon commissioned of a felony, assault with a deadly weapon on a peace officer, inflict great bodily injury on another in the commission of a felony, battery with serious bodily injury, resisting arrest causing great bodily injury, stolen auto, felony possession of stolen property, felony evading causing serious bodily injury, reckless driving causing injury, felony evading a peace officer, unlicensed driver, and resisting/delaying a peace officer," the SFPD said via written statement.

The suspect also goes by "Maurquise Johnson," according to multiple news reports.

Johnson, who was arrested last December on a drug charge and convicted of possessing a controlled substance (crack and marijuana), in February, after which he served 67 days in jail, made his first court appearance in this case Friday, ABC 7 reports. And while there, he "interrupted his attorney several times," addressing the judge directly.

When called by name, ABC 7 reports, Johnson "corrected the judge and gave another name -- Willie Flanigan." (For the sake of clarity, however, I will continue to refer to him as "Johnson" throughout this report.)

Johnson will be defended by Public Defender Alex Lilien, whose name you might recall as the attorney who successfully defended Castro corpse mutilator David Munoz Diaz from murder charges in a headline-grabbing choking death during a sexual encounter at Buena Vista Park.

It looks like even the able Lilien will have his hands full with this case, as he told ABC 7 that "There is going to be video -- I'm sure witnesses, statements, multiple statements, and interviews. And the lives, it's irresponsible for me to comment on very much until I've seen all of that."

While in court Friday, Johnson pled not guilty then "objected when bail was set at $10 million, saying he was a non-violent offender and called the judge's action 'racist.'" He remains in custody as of publication time.

Meanwhile, Lewin-Tankel remains in San Francisco General Hospital. An update on his condition had not been provided as of publication time, but on Friday Police Officer's Association President Martin Halloran told ABC 7 offered a hopeful sign, saying "He is certainly doing better than he was Wednesday."

"Elia is a fighter," SFPD Bill Scott said last week of Lewin-Tankel, who at last report remained in critical condition at the intensive care unit. "...And the fight is not over."

A San Francisco Fire Department Battalion Chief was sentenced to a year of probation this week, after he pleaded "no contest" to charges following a violent physical confrontation with a female co-worker at a popular area restaurant.

Bay City News reports that SFFD Battalion Chief Samuel Romero initially faced domestic violence charges after he reportedly slapped a woman and punched a man while dining at the Original Joe's restaurant in Westlake on February 20.

According to BCN, the confrontation began when the male victim apparently made a comment regarding the difference in age between Romero and the female victim, who is also employed by the SFFD.

The male victim's relationship to Romero is unclear, and the female's under debate: Prosecutors initially claimed that Romero and the woman were a couple, hence the domestic abuse allegation. However, as the case progressed “The victim didn’t want to see it go forward, as is so often the case,” San Mateo County District Attorney Steve Wagstaffe said.

According to Romero's defense attorney, Julia Jayne, Romero and the female victim were not romantically involved, making the case one of "simple battery, not involving domestic violence,” she said.

“She was not his girlfriend, and that’s why there was no domestic violence plea,” Jayne toldBCN. “They’re firefighters and friends but not in any sort of romantic relationship.”

Friends they might be, but now they are friends with a court order between them: According to BCN, in addition to the probation sentence, Romero got two days of jail time (which he'd already served), $235 in fine, and strict instructions "prohibiting him from harassing the female victim."

It's also unclear if the victim in the battery case is the same woman referred to in a November, 2016 report from KTVU. According to the broadcast station, a female firefighter they name as "Jane" said that when she was transferred to Station two in Chinatown in January of 2016, two male firefighters began harassing her, "hiding her boots before a firehouse inspection, spreading feces on her bathroom floor, and urinating in her bed."

The male firefighters denied the claim, instead telling KTVU that "the charges are ironic, they believe it's 54 year old Battalion Chief Sam Romero, who was stationed at Firehouse 2, who was acting inappropriately by having an affair with Jane, his subordinate."

Following an investigation into the allegations of a relationship between Romero and "Jane," which KTVU documents in detail here, "Romero was reassigned to station 31 in the Richmond permanently, just one neighborhood over from Jane's house."

According to San Francisco's public employee salary information database, Romero's total pay and benefits for the year 2016 was $321,038.97, including a base salary of $182,944.87, overtime of $55,924.52, and "other pay" of $28,097.05. At the time of his March arrangement, BCN reports, Romero remained on active duty with the SFFD. A call from SFist to the SFFD to confirm if that remains the case was not returned as of publication time.

NorCal Man Allegedly Pees On Cop During Nature Preserve Arrest, Poses For Alarming Photo

Following the arrest, the suspect was freed on his own recognizance.

SF News

arrest

crime

meth

Mug Shots

placer county

Eve Batey

A man who police say was "acting bizarrely" at a Placer County nature preserve was arrested last week, following a struggle during which he allegedly urinated on a deputy.

The man you see in the photo above was spotted by "Placer County Sheriff's Department Sergeant Dellinger, Deputy Carlton, and Alcoholic Beverage Control Agent Wright" Thursday evening at around 9 p.m. at the Miners Ravine Nature Preserve, the department says via Facebook.

The man, identified as 55-year-old Sacramento resident Steven Holley, "was acting bizarrely and definitely did not look like he was interested in the beauty that the park offers," the PCSD writes.

It's unclear what did send Holley to the area, but police say that he was discovered to have meth and "drug paraphernalia" on his person.

He was arrested following a "brief struggle," they write. During that struggle, Deputy Carlton apparently got the worst of it, as he was allegedly "urinated on" by the suspect.

According Placer County Sheriff's Office records, following his arrest on September 8, Holley was released on his own recognizance. As of publication time, he remains free to again enjoy nature's bounty or, one hopes, seek help for any issues he might presently be facing.

A prowler who broke into a Clay Street residence was arrested this morning, after his victim grabbed him and refused to let go until police arrived.

According to the San Francisco Police Department, the hot prowl was called in at 12:55 Thursday morning, after the 33-year-old suspect apparently used a garage door opener to enter the home.

The 39-year-old resident heard the incursion, and confronted the suspect in the home's garage, police say.

Though the suspect tried to flee, he was unsuccessful: The resident grabbed onto the suspect, and "physically restrain"ed him until police arrived.

The suspect was arrested, police say, and was booked into San Francisco County Jail.

A woman was arrested Saturday at BART's MacArthur station, after witnesses say she was physically abusing her two young children as she stood on the platform.

Bay City News reports that 28-year-old Oakland resident Cherrelle McMillion was arrested a little after 1:08 p.m. Saturday, after a patron alerted the MacArthur station agent that "a woman who appeared to be intoxicated was abusing her two small children, a 9-year-old girl and a 22-month-old toddler."

Police arrived at the station shortly thereafter, and found McMillion on the platform, kids by her side.

BART police say she was seen shoving the toddler, and backhanded, punched, and slapped the 9-year-old girl, "causing redness to her head and neck."

Officials called McMillion's family members, who rushed to the scene to take custody of the kids after the youngsters were cleared by medical crews. Child Protective Services will also be investigating, BCN reports.

McMillion has been booked into Santa Rita Jail, BART police say, and is expected to face charges of public intoxication and corporal injury to a child.

If you feel like more and more cars are being broken into on SF streets, you're not wrong: According to data from the San Francisco Police Department, there's been a 28 percent jump in reported auto burglaries as of 2017.

The SF Examiner gets the credit for this revelation, as it was they who put in a public records request that forced SFPD to give up the numbers. And the numbers are not good, as police say that as of July 2017, there were 17,970 reported vehicle break-ins in San Francisco. That's nearly four thousand more than this time last year, when police say 13,995 were reported.

Hardest hit was SFPD's Northern District, which covers the oft tourist-laden area in this map:

The Ex reports that there have been 4,003 reported auto burglaries in that area so far this year, a 40 percent increase over the figures from 2016.

But the most shocking increase was suffered by those served by SFPD's Mission Station, which covers the area you see in this map:

Reported break-ins of vehicles parked in that zone have tripled since last year, with "a 182 percent spike from 601" reported break-ins this time in 2016 to 1,693 in 2017, the Ex reports.

SFPD spokesperson David Stevenson seemed nonplussed when contacted by the Ex, saying via email only that “The numbers reflect a trend that requires further analysis."

Chief [Bill] Scott has directed the Department to increase its uniformed presence on city streets to deter these and other quality of life crimes,” Stevenson said via email, but did not elaborate further.

Supervisor Hillary Ronen, whose District 9 includes some of Mission Station's coverage area, was less circumspect when speaking with the Ex. “I’m not surprised and I’m angry,” she said.

“My constituents are angry about the epidemic of car break-ins in San Francisco and my district as well," she said. “It has not felt like the city has taken this seriously enough or has had an adequate response,”

A man was arrested at the Bay Fair BART station Tuesday, after he allegedly battered a patron who refused to give him money.

The incident was detailed in a Facebook post published by the transit agency Tuesday evening. According to BART, "an aggressive panhandler battered a passenger after the passenger refused to give him money" at BART's Bay Fair Station Tuesday.

"The suspect tried to run off but our officer detained him," BART says. "The victim identified the suspect and placed him under citizen's arrest for aggressive panhandling and for battery. The suspect was on probation and he was booked into Santa Rita Jail."

He was also "issued a prohibition order which means he can not return to BART," they say.

According to BART, while "panhandling is considered free speech under the law," "aggressive panhandling" such as the type alleged Tuesday "is a violation of the penal code and is not tolerated." That assertion is already being questioned by some respondents to BART's Facebook post, including concerned citizen Ken Meeuwse, who says "Wrong, BART. Panhandling is free speech WITH certain restrictions. BART is a transportation facility...a 'nonpublic forum'...especially inside the paid areas, on platforms and trains."

Citing what appears to be an unofficial publication called "A Guide to Regulating Panhandling," Meeuwse claims that "When one is a paying passenger, the express purpose of these areas is to transit from point 'A' to point 'B', without being harassed. It does not have to be 'aggressive' panhandling for BART to enforce in these areas. Period."

"Why is BART's public relations gaslighting us by avoiding their failure to enforce on panhandling generally and implying it has to be 'aggressive' before they can do anything?" Meeuwse asks in a subsequent comment, calling BART's announcement of the arrest "Incompetent messaging and nonsense."

According to BART, the fact that the victim remained on the scene and cooperated allowed them to make the arrest. "Unless police witness something," BART writes, "we need our riders to provide a statement and identify the suspect as the right person."

In a welcome change of pace to the many stories of unsolved BART crime, BART police say they made at least two arrests this weekend, both at stations in San Francisco.

The first crime and detention occurred Friday night, Bay City News reports, at SF's 16th Street Station.

According to BCN, it went down on the escalator at around 10:21 p.m.. First, a male suspect made a grab for a fellow rider's hat, police say, then "grabbed a second patron's cell phone."

The victims reported the escalator aggression, and "officers responded and located a suspect who was positively identified by the victims." The suspect, who has not been publicly identified, was booked into San Francisco County Jail on suspicion of robbery.

BART police had a second alleged miscreant to deal with in SF on Saturday night, KRON 4 reports, after an armed man menaced a group of women in Richmond.

It was 11:48 p.m. Saturday when the man allegedly approached a group of women as they stood on the platform of the Richmond station.

The man "made unwanted sexual advances" toward members of the group, police say. When the women refused his harassment, "he pulled out a knife and threatened to harm them."

The women reported the incident, and police tracked the man to SF's Embarcadero Station, Bay City News reports. There they "arrested him on suspicion of brandishing a knife and making criminal threats."
