Murder Suspect Busted For Smoking A Cigarette

cigarettesbutts.jpg Finally, California's nanny state smoking restrictions have made the world a better place. As the Oakland Tribune reports, murder suspect Franklin Bean, wanted for a December 17th shooting in Fruitvale, was nabbed in last Friday night after he was busted for smoking a cigarette too close to the entrance of a Hayward bar.

In Alameda County, as in San Francisco, smoking is prohibited within 20 feet of the entrance to drinking establishments. Bean made it a whole six feet out the door before two Sheriff's deputies slapped him with a $500 citation. While running Bean's ID through the computer, the deputies discovered an outstanding warrant for his arrest. This is, apparently, the first time a murder suspect has been busted for cigarette smoking.

    As a smoker, I try to demonstrate common sense and not smoke near windows and doors and what not.  But, at least in San Francisco, 20 feet buffers are really hard to find.  I've always wondered if you are breaking the law and subject to search and seizure by police if you simply walk by a bar while smoking (since technically you are temporarily within 20ft)?
