On Sunday, Matier and Ross carefully stepped into some potentially controversial territory in pointing out the open secret that federal Judge Vaughn Walker is gay. Walker will be delivering a decision concerning the overturning of Prop 8 — a judicial referendum on gay marriage which will next head to a federal appeals court and likely also to the Supreme Court, where it will create a national uproar.

Walker did not seek out the case; it was assigned to him at random. And Prop 8 backers have so far kept quiet about Walker's orientation, waiting to see how the case turns out. In seeking the job as federal judge, Walker previously had to disprove allegations that he was, ironically, anti-gay, due to a case he he tried in private practice in the early 80s in which the U.S. Olympic Committee sued San Francisco's Gay Olympic Games for use of the Olympic name -- Walker acted on behalf of the plaintiffs, who won, and consequently pissed off a lot of gay people.
