According to Columbian.com, Giants star Tim Lincecum was busted on October 30 for smoking and possessing marijuana. "The amount was 3.3 grams, [Washington State Patrol trooper and spokesman Steve] Schatzel said, which is considered only enough for personal use. Lincecum did not appear to be impaired behind the wheel and is not being charged with a felony crime." He was busted while driving in I-5, charged with misdemeanor possession. (via The Splash)

He was not busted for pot. He was busted for speeding.

Depends on what you mean by "busted."

Cops can do a "Terry" stop and frisk when they pull someone over, i.e., frisk the person + search the front of the car, including the glove box / passenger compartment. The only requirement is that the cop must have "reasonable suspicion" that the person is committing, committed, or about to commit a crime.

It's not uncommon for CHP and other law enforcement to do that on the I-5 corridor. People speed there all the time. Now a cop CANNOT Terry stop + frisk a driver for speeding IN AND OF ITSELF, because by the time the driver is pulled over the cop has all the evidence they need for a charge.

What happens is that the cop pulls over the driver for the speeding offense, and only then establishes reasonable suspicion, e.g., smelling pot, seeing roaches, whatever.

After that reasonable suspicion is established, the cop can frisk the driver and search the front of the car, including the passenger compartment. Rationale: Cops do not know what they face when they pull someone over; it's a safety mechanism to facilitate smooth law enforcement. Why only the front of the car + glove box? Because, the argument goes, the driver cannot readily access the back seat or trunk, but that concept is related to searches incident to arrests, a completely different concept.

Shhhhh . . . you don't know what you are talking about.

That should have been @lejohnnyc. Sorry.

lejohnnyc, how is your outline for the criminal procedure final going?

Please enbiggen the picture.

I'm normally not into sports at all, but I love that this kid, that still looks like a lanky kid straight out of Dazed and Confused with his hemp necklace and scruffy hair, is up there and striking out there steroid Frankensteins that are twice his age.

Not sure what happened to professional baseball, somewhere along the line it became WWF and every other player looks like Hulk Hogan or Randy the Macho Man Savage.

Awesome that we have a kid that doesn’t seem to be into that and is still smoking those guys at their own game.

two words: "bash brothers"

that said, 3.3g? the dealer sold him a light eighth and snitched after he left.

Light eighth? More like playa had alreay twisted a coupld fat bones from the quarter he was holding.

Proof of what Fugazi said:

I for one, support the young hesher.

Thank you fugaziaboutit for putting it so smart and colorfully. I felt the same way about Michael Phelps.

I liked him before, I like him even more now. Once upon a time, Orlando Cepeda was busted for pot. In a different era, he was ostracized and vilified for that. I would hope that we're all a bit more enlightened now.

actually, NOT for smoking, just for possession. If the cop had thought he was driving stoned, he probably would have been arrested.

This guy does seem pretty cool.

As far as role models go, he's young, talented and an awesome pitcher. Oh yeah, and he likes the meanie greenie. Big effin deal.

Steroids and crack would be bad - we're looking at you Bonds and Canseco. A few bong hits after throwing 90mph fastballs for a few hours is no different than knocking back a few cold ones. Plus, his street cred and shirt sales just jumped.

Good for him. Stay healthy and mellow Tim!

who is this Terry and how does he know Lincecum?
