just as an example of malice aforethought: drawing a weapon for intimidation. it does not require premeditation or any of that dragnet stuff. in fact, if you think about that group of officers patrolling on NYE, it's not hard to imagine them talking shit about various people, possibly using the words "thug" or "gangbanger" and maybe saying something along the line of whether someone should put them in their place, they need parenting, or jobs, or whatever. maybe he said that if someone comes at him...sure, he was joking! if someone comes forward as a witness to any conversation like that, things could turn very bad indeed for mr. mehserle.

I took BART yesterday and believe it or not, for some reason I did not get yanked off a train, shot or killed. Nobody pulled me off a train and there were no BART, Oakland or SF police officers cuffing or kneeling on the back of my neck. I wonder why that was the end result of my little trip. Based on some of what you extremists contend, we're all under siege from the powers that be. Oh yeah, I put my ticket in the little machine, sat my polite ass down and rode the train to my destination. I managed to not start any fights, pull out any weapons or get into a fight with the guys with guns. Fuck Oscar Grant and any apologist who makes excuses for poor civil behavior. That little bitch is dead because he was acting like a tough guy, thug, fighting the power, being an all around idiot and got his just desserts. Hope he has more success pushing up daisies than he ever did as a very unproductive member of society.

Cops are held to a much higher level of accountability. Every time an officer discharge their weapon, they are placed on mandatory leave while an investigation takes place. Obviously that didn't prevent this tragedy, but to say they aren't held to a higher level of accountability is just silly.

I am sure if this incident was not captured on video there would be no charges filed and the officer would have gotton off with just a slap on the wrist and a course in anger management. His Dad Todd has anger management problems too, I hope his Dad now realizes what a crappy son he has. Sell the sailboat and give the money to a lawyer-serves him right. also, even if it were a complete accident (and it probably was), the fact that cops treat black men differently is still true. if a couple of white frat boys were fighting on the train, i don't think the cop would have responded so defensively. cops should be trained not to treat a person differently based on their race. odds are a few "FRAT" boys ussually do not carry guns like a majority of young black men in OAKLAND, same crap at the AIRPORT , can't remember the last time my granny hijacked a plane. Can't recall FRAT boys shooting each other....

yeah, I figured that. But I haven't really seen anything definitive about what really was the cause of them being pulled out of the train or what was the truth of oscar's involvement so I'm unable to comment on that. There's no way to reasonably draw any conclusion that Oscar was being violent and that's what caused him to be pulled out of the train. Unless I've missed something, for all we know he was pulled out because he was being rowdy or mouthy and defending his friends.

Actually, it was stupidity and disrespect that put him in this position. After being detained and put in a prone position he got mouthy with the cops, got riled up and started to stand up, so they put him face down to control the situation. *Then* he was shot.

The facts will come out and Meserle will not be charged with murder. I bet they are doing it to appease the rioters and family. I can't believe the stupidity of people thinking setting things on fire, protesting and throwing things will help make things better. Oscar declared a saint because he was shot by police instead of a gang leader is going to far. It's violence that got Oscar shot in the first place. End the violence and no one will get shot again, now that makes more sense.

And out of respect for all of society and the process we refer to them as 'alleged.' Well, I've been Mr. Allegedly lately, so let me explain why I think it's warranted. The evidence certainly indicates that Mehserle shot and killed Grant. But it does not indicate anything else - notably intent and/or premeditation. So to say that he allegedly murdered Grant is exactly right. You could say, if you wanted to be highly precise, that Mehserle was seen shooting Grant, and allegedly murdered him. But that's too many words for the lead to a blog piece. In any case, we shall soon see what charges are filed.

SF got murder for Marjorie Knoller (which was also a first, of sorts) but Alameda will never get a murder conviction of any degree in this particular case. Of course there are a few less serious charges available - one of those will stick. Eventually.

as orloff said in his press conference, the DA does not specify the degree of murder. the judge will decide if the charges stand as stated, and the jury will have instructions on how to find for lesser forms of killing. that is, the degree will be decided by the jury from what i can tell.
