oh, and this varies a LOT between states (ie, kentucky law) what I just mentioned is regarding CA laws.

Katy: Basically, you have to know that the person committed the crime (if a misdemeanor, you must have actually seen the crime take place...for a felony, you just need knowledge of the crime) and the person you are attempting to arrest has essentially got to be okay with the arrest...which is the problem. Especially for felonies. Most people won't volunteer to stick around for a citizens arrest, they will attempt to flee, which will then lead to assault/battery/false imprisonment charges being placed on the person attempting the arrest...depending on how far you take it. I guess, perform all the citizens arrests you want...just don't touch the person or keep them beyond their will. Which means, you probably won't be successful.

Isn't it funny how whenever Code Pink or another citizen yells from the audience (yes i know she went on stage this time, too bad she couldn't do what this gov't should do) at a right winger, they are arrested or thrown out immediately. But yell Kill him, Terrorist, etc., get methed up and plan on shooting Obama during the convention...nada. zip. FBI says they are trying to find out who said it. For the love of everything good, someone got thrown out of a SHOPPING MALL for wearing an Impeach Bush t-shirt. If you think Code Pink is crazy, you might want to take a closer look around you. At least they are trying to do something.

Too bad it wasn't in Kentucky. Kentucky criminal code (s.37) states that a private citizen has the authority to kill a fleeing felon while making a citizens arrest. (I had to do a paper on citizens arrest...my advice, don't try it)
