1. It is possible to infer that somebody is dead without having a body. That&apos;s in fact what the jury decided: that Nina Reiser was killed, and that Hans Reiser killed her. The manner of her disappearance was a big part of the prosecution&apos;s case against Hans Reiser.

2. If that were true, doesn&apos;t that just reward murderers who are good at getting rid of the body? 

As in, what if a yachtsman was charged with killing somebody, and dumping their body overboard at sea. It&apos;d be impossible to recover the body. It&apos;s still possible that the person is alive, but is it probable? Did the yachtsman have motive? Opportunity? What about other evidence, like blood stains on the boat? What about the behavior of the yachtsman after returning? Would you not even consider these facts if you couldn&apos;t find the body?&lt;/p&gt;</description>
