Mayor Gavin Newsom had told reporters that he would decide by Tuesday whether to intervene in the matter. Under San Francisco law, Newsom has the authority to suspend and eventually remove Jew from office for official misconduct through the city Ethics Commission and Board of Supervisors. 


Of course, Mayor Gavin Newsom is not playing politics with the critical issue of supervisorial legitimacy, what, with waiting to consider suspension after the deadline for the voters of D4 to have a say this November over their representation.

Newsom would rather have his appointment serve as long as possible without having to face the voters.

And as to guest/marc&apos;s comment [1], the Examiner is reporting that if Ed Jew resigns after that date, the city charter allows the appointed official to stay through Ed&apos;s term.  I don&apos;t know if you&apos;re right or if the Examiner is, I just point it out.  &lt;/p&gt;</description>

<description>&lt;p&gt;(c)   Any person filling a vacancy pursuant to subsection (a) or (b) of this Section shall serve until a successor is selected at the next election occurring not less than 120 days after the vacancy, at which time an election shall be held to fill the unexpired term, provided that (1) if an election for the vacated office is scheduled to occur less than one year after the vacancy, the appointee shall serve until a successor is selected at that election or (2) if an election for any seat on the same board as the vacated seat is scheduled to occur less than one year but at least 120 days after the vacancy, the appointee shall serve until a successor is selected at that election to fill the unexpired term.


If Jew resigns by 10 July AND Newsom appoints a replacement, than that supervisor would have to seek election in November.

That is not going to happen because Newsom would prefer to appoint a replacement after that deadline to push it off to a subsequent election.

If Newsom appoints a replacement before the November election, then that person would have to run in February.

If Newsom appoints a replacement after the November election, then that person would run for election in November 2008 with the odd district supervisors.
